It is only mis marked, and they are only obligated to give the product to you at the lower price, "IF" the bar code on the package, and the bar code, along with the product discription on the shelf price tag match, otherwise it just the person stocking the shelves, putting an item in the wrong place.

You can't claim the lower price was the advertised price, because the item being advertised for that price, is the one identified by the bar code and discription on the shelf tag, which may or may not be the item on the shelf.
