But really, that would sound a lot like those guys who were recently hassled in PA (Dickson Dozen or something) and one of the guys was arrested. PA is no license required to OC either, so idk how it would work out...

IIRC A member of the GlockTalk Indiana forum asked the THPD to cite the ordinance, and was met with "the sound of crickets".

Ask them to cite the ordinance number. Or even the section of the municipal code where it is.

They can't, because the ordinance does not exist.

Google for Terre Haute Municipal Code and read through it yourself.

THE ORDINANCE DOES NOT EXIST. THEY ARE EITHER IGNORANT OF THIS FACT OR LYING. THERE IS NO OTHER POSSIBILITY.

rhino, these are officers of THE LAW, so they must know what they are doing.

In a deposition Friday, I asked a state cop about the importance of exculpatory evidence (they did not turn over a video tape on an OWI), the state cop had no idea what exculpatory meant and finally admitted that she could not define it.

Right then, these THPD threads are becoming a headache so remember this: the worst possible person to ask what the law is is a cop. Cops make it up as they go along and insert their own views for the law. Stop asking cops. That is all.

true, but i was just posting what i was told by two different officers. my intent was to alleviate any potential headaches he would have in the area.and while you know the law foward and back,just like you said, cops make it up as they go along. if two officers have the same idea in their heads the likelyhood is high others would have the same idea.it can be as legal as the day is long, but if all the locals think it is'nt there could be a problem.

munky, yes, of course you are quite correct.

I believe the best thing to do is what I did in Wheatfield: when the cop quotes you "the law", tell him to go get the statute or call a supervisor. That kept me from having to see the inside the Jasper County jail.

, bad part is too few people educated enough to do that. or in the case of the police here in brazil, if you ask them anything you basically get arrested for f'ing with the police. my town is lawsuit waiting to happen

munky... the next time you talk to those guys, really do ask them to cite the ordinance. When they can't, helpfully suggest that they might want to rethink enforcing a law that does not exist.

We can give them the benefit of the doubt and choose to believe they are just ignorant of the law, and could benefit from this information.
