However, legislation was recently passed that repealed that statute. ************************************************** **** Restraints lifted on Tennessee guns-in-restaurants bill : Mid-South : Memphis Commercial Appeal Restraints lifted on Tennessee guns-in-restaurants bill Committee removes restrictions on hours, types of establishments By Richard Locker (Contact), Memphis Commercial Appeal Monday, May 4, 2009 NASHVILLE -- A House-Senate conference committee Monday removed restrictions from a bill to allow handgun-carry permit holders to take guns into restaurants that serve alcohol provided they are not drinking or under the influence of alcohol. If the committee's recommendation passes both chambers as expected later this week, the bill would go to Gov. Phil Bredesen, who can sign it into law, veto it or allow it to become law without his signature. The conference committee was created to negotiate a compromise between the House-passed version of the bill, which imposed restrictions on guns in restaurants, and the Senate version with virtually no restrictions. Under current Tennessee law, guns are banned from any establishment that serves alcohol. The House version of the bill allowed those with carry permits to take guns into restaurants serving alcohol except between the hours of 11 p.m. and 5 a.m. and completely prohibited them in restaurants closed to minors. The House version also specified the new law would go into affect immediately upon passage. The Senate version has a June 1 effective date. In the conference committee, Rep. Curry Todd, R-Collierville, House sponsor of the bill, moved immediately to drop the House version and accept the complete Senate version. That brought protests from two House colleagues who argued that the study committee had recommended the curfews and that Todd had committed himself to that approach. "I was never for the curfew. I agreed to it in the study committee, but we're in the conference committee now," Todd said. But last month when the bill was up for a House floor vote, Todd vigorously opposed an attempt to remove the time curfew from his bill. He told reporters at that time, "I'm not going to vote for a measure now that doesn't have a time frame on it because that opens it back up to bars." After the committee adjourned Monday, Todd said he believes the Senate version is better. "I didn't support the hours when we first had the study committee. I proposed 11 o'clock to get the bill out of the study committee. That was a better proposal than the restaurant association's (which had favored banning guns after 9 p.m.). I agreed to not put any amendments on it as long as I had it in the House. This is a conference committee. It's not in the House." Rep. Joe Armstrong, D-Knoxville, asked to allow local communities to set their own standards. He said Knoxville's police chief had written him to oppose guns in places that serve alcohol. "In Knoxville, we have 110,000 people in town for football games and 25 percent of them are from the other side. There are fights. Restaurants in Knoxville have made it clear they don't want this," Armstrong said. The bill allows restaurants to post signs banning guns in their businesses.
