Decorated Vet Arrested After ‘Rudely Displaying’ His Rifle. My "favorite" part is at 3:55 when the Sargent tells him police are exempt from the law. He alarmed people by carrying his evil black gun, and the Sargent told him the people who saw him "they don't care what the law is". You would think the officers would care what the law is, but nope.

The douche with the rifle is a big mouth idiot. Not sure what when down before the filming started but a classic example of how NOT to act. Some people are their own worst enemy. Oh and ya good example for a dad.

Yeah, he seemed like a loud-mouthed jerk, but guess what: being a loud-mouthed jerk isn't against the law. I guess most people should just cower when they are wrongfully detained.

No not at all. One should be reasonable in what they do. While I know nothing of Texas state law it is obvious that our idiot made his own situation worse by his child like behavior. Had he acted just the least bit reasonable like most other people would have he would have been down the road in short order. :twocents:

Texas law is kinda funny on this issue, it appears. I mean this IS Texas, given that one can OC without a license, I'd imagine that Texas LEOs see it a lot. So what exactly was the issue in this case? Do long guns meet a stricter requirement than handguns?

And yeah, that guy had a big mouth. If the officers were right or wrong, he simply should have calmly stated his case, and complied.

It's good to know that there are still people on INGO who believe that when our rights are violated and police act illegally outside of the law, that we should just shut our mouths and bend over. "Hey Tina, just be quiet while the officer 'does his thing' we'll settle it later with a lawsuit."

The police acted on irrational fear, disregarded the law, made up excuses on the spot, and had no idea what they were doing. So the fat one and the Sargent went off to have a little pow-wow to decide what they could charge this guy with so that they could cover their asses. They charged him with the horrible crime of "scaring other people" and "arguing with an incompetent police officer".

Hope Temple, TX has good insurance.

You think that kids father handle himself appropiately? :n00b:

Hey, he may have been in the right, but exactly what did he expect to accomplish by making a scene?

The cops there detained him, confiscated his weapons, put him in handcuffs, told him the were exempt from the law, and arrested him for "Rudely Displaying" his gun, and you have the gall to say HE is the one who made a scene?

Don't protest when your rights are being violated, you'll sound like a "big mouth" "douche".

Come back to earth. There's a difference between the way things "should" be, and the way things "are." I tell you, right out, that it is wrong for that officer to make a scene, and I agree that he did. However, at the end of the day any encounter, on the side of the road, is going to go his way. So like I said, what did the other guy hope to accomplish by making a scene too? All he did is make himself look as least as bad as the officer. He should have calmly stated his case, complied, and sought a civil remedy to his detainment and disarmament. His attitude may have just made any chance at a successful suit, very remote.

How dispense with the "selective" reading and read the whole posts. :dunno:

    por ejemplo:

...he simply should have calmly stated his case, and complied.

Not sure in what version of the English language "calmly stated his case" is akin to "don't protest" or "shut our mouths."

Something tells me he is (hint: click on the link)
Unless you think being awarded the Bronze Star with Valor for his tours in Iraq and Afghanistan isn't up to your criteria..

You would figure someone who was awarded the bronze star would act a little more civil in front of his child.

    Let's dig further...

Texas Penal Code 42.01 Disorderly Conduct. (a) A person commits an offense if he intentionally or knowingly (8) displays a firearm or other deadly weapon in a public place in a manner calculated to alarm; (c) for purposes of this section: (1) an act is deemed to occur in a public place or near a private residence if it produces its offensive or proscribed consequences in the public place or near a private residence.

    http://www.txdps.state.tx.us/internetforms/forms/chl-16.pdf

Seems that a number of things could be applied to justify a stop, without even stretching it.

    Intentionally displayed firearm? Check
To cause alarm? Contact required to determine, and since it's related to the suspicion of a crime, disarmament is justified.
In a public place or near private residences? Check
Offensive and in a public place or near a private residence? Check... somebody was obviously offended, right?
