| Avatar pictured below may not be actual size ![]() | The main difference between the cookie jar metaphor and what actually happened in this guy's case was that they were robbing a neighbor's house and he left the safety of his own home to escalate the situation, and ultimately ended up shooting them in the back. Personally, I didn't see any instance where his life was being threatened.

Indiana Code 35-41-3 Without a threat of violence, I cannot think of any real circumstance when that level of force would be required to terminate someone's unlawful entry. Short of the use of deadly force, one can ask or tell the trespasser to leave, can physically force his/her departure, or can call 911 and have the folks in blue do the same. (remember, that's when there is no threat of violence. I just can't get my crystal ball working enough to tell me with 100% accuracy when there is no such threat.) I'd say Mr. Horn did the right thing in the (very) wrong way. He defended that which belonged to his neighbor, which is admirable. A camera would have been a better choice of weapon, backed up by his sidearm if he was seen photographing or taking video. Blessings, B | |

![]() ![]() | Macadamia nut. ![]() But seriously, the last thing I ever want to do is kill someone, especially over property...Not that I'd feel bad that one less turd is off the street, but the legal fees would be ridiculous. Unfortunately my house is set up to where if you want to steel something valuable, you will have to pass where I am sleeping and if I here you and get up, fleeing is not an option. So the BG will either: 1. Get on the floor and be held at gunpoint until the police arrive. 2. Run towards the door(which is at me). Running towards the door is not a good idea. |
