And really, to be honest, even at 3AM, if someone comes in and is just standing calmly at my cookie jar, no, I'm not likely to shoot him, but who's going to be in your house at 3AM or any other time JUST to steal a cookie from the jar? to Bazooka Joe; if I feel he or she's a threat in my house, he or she will (maybe) have one chance to get on the floor or high-tail it out the door farthest from me. The main difference between the cookie jar metaphor and what actually happened in this guy's case was that they were robbing a neighbor's house and he left the safety of his own home to escalate the situation, and ultimately ended up shooting them in the back. Personally, I didn't see any instance where his life was being threatened.

Yup. There wasn't one until he disregarded the dispatcher's directions and went outside. Sometimes, it's better to be a good witness. Mr. Horn was protecting his neighbor's belongings, however our guns are, in fact, for defending against immediate threats to life or limb. That said, we have forever to think about this and discuss it with all the whys and wherefores, and too, IN law does seem to permit the use of even deadly force solely to terminate someone's unlawful entry into his home, yard, or occupied motor vehicle if that level of force is deemed necessary to achieve that result.
Indiana Code 35-41-3

Without a threat of violence, I cannot think of any real circumstance when that level of force would be required to terminate someone's unlawful entry. Short of the use of deadly force, one can ask or tell the trespasser to leave, can physically force his/her departure, or can call 911 and have the folks in blue do the same. (remember, that's when there is no threat of violence. I just can't get my crystal ball working enough to tell me with 100% accuracy when there is no such threat.)

I'd say Mr. Horn did the right thing in the (very) wrong way. He defended that which belonged to his neighbor, which is admirable. A camera would have been a better choice of weapon, backed up by his sidearm if he was seen photographing or taking video.

But seriously, the last thing I ever want to do is kill someone, especially over property...Not that I'd feel bad that one less turd is off the street, but the legal fees would be ridiculous.

Unfortunately my house is set up to where if you want to steel something valuable, you will have to pass where I am sleeping and if I here you and get up, fleeing is not an option. So the BG will either:

1. Get on the floor and be held at gunpoint until the police arrive.

2. Run towards the door(which is at me).



Running towards the door is not a good idea.
