    I believe I can provide at least a partial update on what is happening in our situation. The neighbor had his trial on Sept. 2nd and was convicted of the criminal recklessness charge. I was waiting to see what they were doing with the charges against his friend who was also there shooting when the DNR arrived, and I guess the prosecutor is still talking to him. No trial date has been set for him and I got notice that he has another pretrial conference in about a month.

    At sentencing, the judge put a ban on shooting on that property for as long as the neighbor lives there. No shooting by him, his family or his friends on that property for any reason with any type of firearm. I was not expecting that, but it sure goes a long way in making us feel safer. If we hear any shooting, we are to call the sheriff's department right away and they will send someone out. He got six months (suspended) with 12 months probation in addition to the shooting ban. It has been nice and quiet and we can actually walk in our woods and feel safe doing so.

    I will update more when a decision has been made regarding the other person who was charged. I can't really give any more details other than this as I do not want to jeopardize the case against the second party. What I have stated above is all part of the public record so I feel comfortable sharing it.

    Is there any info in this thread about how criminal recklessness got brought into it?


    It was due to the manner in which they were shooting. Hundreds of bullets left their property and caused damage to our property and had my husband and a neighbor both trapped behind trees on our property. When they started shooting on the day the authorities were called out, another neighbor to our west and my husband were both in the woods...neighbor searching for a lost arrow and my husband setting up a ground blind...and bullets were whizzing past both of them. My husband made a run for the house. The neighbor was in the direct line of fire and had bullets flying by him on both sides of the tree he was hiding behind. He thought for sure he was going to die right there.

    The DNR is the one who determined what to charge them with, and the prosecutor agreed apparently.

    how much damage?


    The estimate I have is approximately $2,000 but the safety issue was a much bigger factor in this case. The judge did tell him that if we choose to pursue it, we are pretty much guaranteed to win a civil case against him for the damages.

    Thanks. We are just sorry it had to take this to get the issue resolved. A backstop was all we were asking for.

    Maybe now they will take your complaints a little bit more seriously. I cant fathom why they thought it was ok to begin with... now they have lost there ability to shoot at all... Seems a bit extreme to me.

    I'm glad its being worked out. Shame the guy was too dumb to put a backstop up. Seems like he's getting 'no real jail time' though. I see that as good as hopefully his life isn't completely ruined(lost job, etc) The ban on shooting is worse. I suspect he'll sell as soon as he can and move to another location..hopefully smarter.

    I read that as no self-defense shooting either. It sucks to be stupid, sometimes.


    No hunting with firearms either so I guess now those deer that are close to his property are much safer as well. I don't think he has ever actually shot one on his side of the line. I think the judge realized that telling him to put up a back stop was going to be pointless based on his attitude and just took it upon himself to set the sentence at the next level. All of the other neighbors have been told if they know there is shooting on that property now, they should call it in.

    I don't see him selling. He lives with his mother-in-law and she is the one paying the bills for the most part. He does have a job, but I do know she is the one who owns the land.
