    SCROTUS isn't going to take that one up. Too controversial for Roberts.
    Well, I don't think controversy will influence an up or down vote on certiorari for this. Frankly, the problem might be that it isn't controversial enough.

    They've had opportunities that they've turned down. Makes it look an awful lot like no one wants a piece of that.

    Yeah, but I think it is more likely that they either think the court of appeals got it right, or they don't think enough people are harmed by an incorrect decision.

    SCOTUS isn't afraid of controversy. They've been re-visiting some set-in-stone positions pretty regularly the last few years.
