Judge allows paralyzed cop to sue Glock

A California appeals court has reinstated a lawsuit against gun maker Glock Inc. by a police officer paralyzed after his 3-year-old son accidentally shot him

    UPI

LOS ANGELES — A California appeals court has reinstated a lawsuit against gun maker Glock Inc. by a police officer paralyzed after his 3-year-old son accidentally shot him.

A Los Angeles judge dismissed a suit brought two years ago by Enrique Chavez, who claimed his service pistol, a Glock 21 handgun, had a light trigger pull and lacked a grip safety, an attached device that requires deactivation before firing.
The judge said the Los Angeles Police Department had reviewed the gun's design, including the force required to pull the trigger, and concluded its advantages outweighed any risks, the San Francisco Chronicle reported Wednesday.
The California Second Court of Appeal said Tuesday a jury could conclude a grip safety strong enough to withstand a 3 year-old's grasp "would minimize the risk of accidental discharge without undermining performance," and in a 3-0 ruling, allowed the case to continue.

Chavez was shot in the back in 2006 while driving. His son had found the gun while riding in the back seat of the vehicle, the newspaper said.

What's next, keeping control of your gun and away from children????

What is this world coming to? Glock should pay!!

Nothing in CA is anybody's fault. It all comes back to a lack of govt enforcement. If you drive drunk and hit a tree, you should sue the planter of the tree or the city for failing to put a guard rail near it. God forbid anyone should be expected to think for themselves.

The morons in CA think life came with a warranty. Stuff happens, and more stuff happens to the stupid.

Yeah, just wait until every gun has to have a trigger pull hard enough that no child could discharge it, and see how it works in action. There's this thing called keeping your gun away from children, as well as a trigger lock, but making the gun virtually unusable does not seem to be a solution

Irresponsible parent causes own near death experience and cries foul. Lovely.

"a grip safety strong enough to withstand a 3 year-old's grasp "would minimize the risk of accidental discharge without undermining performance"

It just might minimize the ability of an injured person from operating the firearm as well. Brilliant idea. Can we offer citizenship to any illegal immigrants who would be willing to go to the CA border and work for six months chipping away until it floats out into the pacific ocean? I'd vote for that, hell I'd vote for a tax increase to pay for it.

The stupid thing is the very lack of these features is one of the reasons police depts switched to Glocks. They are simple and don't have any switches to disengaged to be used quickly.

But considering police were carrying double action revolvers with no safety features of any kind for almost a century, this decision makes no sense.

Well I hope Glock is going to counter sue the dumb ass cop that let his 3 year old son have access to a loaded gun.

I say throw his crippled ass in jail for 40 years and he can pursue his lawsuit after he serves his sentence. By the way while we are allowing all this superfluous litigation, lets as a society sue said cop for passing the stupid gene to his son.

it is a lawsuit that is allowed to continue not the verdict as I understand it
Right, there has been no verdict yet, it was dismissed but know it's allowed to go to court again. Given the years of coaching on firearms for over a generation now in CA, there are comments made on the assumption that the lawsuit will win with the assumed level of firearms education, gun knowledge and coached stance of those jurors (presumably, unfamiliar with CA specifically) and judges who will see the case. The fact that this was even filed, let alone dug up from over 2 years ago and allowed to be un-dismissed speaks volumes to the character of those involved, and it's at a convenient time, during a push for gun control after a mass shooting in a gun free by legislation zone.
