    I'm confused, does anyone know more about this?

    Why? BECAUSE YOUR GUN WENT OFF IN WALMART!

    I'm glad no one was hurt, surely there was some sort of damage.
    Surely the gun owner will pay for any damages, but this is negligence.
    Dangerous negligence. People get ticketed for failure to maintain control
    their vehicle if they scratch up a guard rail while wrecking their car.

    I don't think the ND'r should have been arrested.
    Is a negligent discharge in public not illegal, like criminal negligence?

    Maybe I'm asking for trouble, and there is no law covering this, and maybe
    there shouldn't be.:dunno:

    Criminal Recklessness requires that you "recklessly, knowingly, or intentionally" do something that could cause serious bodily injury. Accidents aren't knowingly done or intentionally done, so that leaves you with recklessly. Dropping something isn't reckless unless you were trying to juggle it or something that contributed to the dropping beyond just using a crap holster.

    Why the hell did he have it out of the holster??

    There is some form of negligence here, I am sure when the prosecutor gets a hold of it some form of charges will be filed.

    WHY do people spend HUNDREDS of dollars on a gun and then stick it in a generic ill-fitting cheapo holster for twenty dollars?! OF COURSE it won't stay there! So that's what my personal guess is as to how it likely happened.

    Sounds completely accidental to me. Still shouldn't have happened, but accidents to happen occasionally. Maybe he bought a crappy holster. Maybe his custom holster was worn out and it just gave up the ghost, losing the firearm. Who knows. We sure don't because it's not in the story. Either way, I bet that never happens to that guy again. And as much as accidents are dangerous with guns involved, all we can do at this point is be thankful nobody was hurt and hope that this man learned from his mistake.

    Riiiight, It "fell" out of the holster. Just like "I was cleaning it and it just went off".

    While it is possible that it fell out of the holster, I am betting there was a certain amount of coonfingering going on, just my opinion.

    Probably because it likely didn't happen that way :dunno: I suppose there may be some still packing an old lorcin or jennings that may go off if dropped or some old ancient revolver without a transfer bar but I doubt it's of modern manufacture. If it was i'm betting on "coonfingering" :) I don't doubt firearms will discharge without fingers but that they usually work as designed and fire with a pull of the trigger whether it's a piece of holster or some other item lodged in the trigger guard. Glad nobody was hurt and if the story is accurate that he gets a good holster now!

    It was probably a glock. We all know, they go off if you look at them funny, and have you seen some of the people in walmart? Funny looks indeed..
