    To Kirk,

Since a judge ruled the "stop & frisk" unconstitutional and the appeal has been dropped, as I understand it the judges ruling now stands.

Does this set any type of case law on the matter? Can this go beyond NYC or is it just a good victory for a small geographic area?

What are the national ramifications of this, if any?

I am hoping there is much good beyond NYC but the cynic in me says "NO."

    Regards,

    Doug

Whatever happened to all the people who were so passionate about stop and frisk? Shouldn't you be jumping up and down in joy? Millions of Americans are now secure against harassment.

No, not really. Case law precedent is derived from the Court of Appeals and Supreme Court.

If other cities were looking to implement this sort of program, those plans are now stillborn.

I cannot explain it. It is like the INGOtarians never had any interest in stop & frisk but merely had ulterior motives.

Maybe they will swing by to join in the celebration?

You actually think it's going to stop? They were stopping and frisking before there was "stop and frisk" and they'll do it after.

It wasn't that long ago that ingopublicans were supporting the the harassment of black customers in New York stores.

YAAAAY!! Oh wait.... Stop & Frisk is still the law of the land. It WILL continue. The only issue at hand is the racial component.

“We believe in ending the overuse of stop-and-frisk that has unfairly targeted young African-American and Latino men.” - Mayor de Blasio

The judge said that it led to "a policy of indirect racial profiling."

Its not the existence of stop & frisk that was ruled unconstitutional, no, its the overuse against minorities.

So now there will be court monitors to verify that all races are being oppressed in equal proportions. Woo hoo!

Perhaps this may lead to less Stops & Frisks performed in NYC, but I think that will be mostly be due to political reasons since de Blasio wants to distance himself from Bloomberg. The new commissioner will be instructed not to incentivize the stops as rigorously. But that doesn't change the legal reality that anyone can be stopped by cops and searched, anytime, for any bull**** reason.

What kind of ulterior motive would that be?

Or, maybe it will lead to more Stops & Frisks of white people, so that things, you know, even out.

im tired of authorities being allowed to just stop infringing upon rights and we all say everything is honkey-dorey....just ceasing the stop and frisk isnt enough, someone needs to be punished for this unconstitutional procedure

Yep, that was my thinking. Scale back on the ethnic S&F and ramp up the stops on whites to where they outpace the racial component so that it's lopsided on the caucasian side, then all will be well. Then we can have everybody's rights violated equally. Or more for the whites. That should make it all right.

Bloomberg used to talk about what a great tool that it was and that it was the biggest reason that crime and murders were down so much. It doesn't make any difference if a policy/law is civilly intrusive as long as it reduces crime. That makes it okay.
