Question about IC 34-28-8-6

I work for a company (day in and day out for many years) as a contractor. Does this mean I have no protection under this statute because I am not technically an "employee?"

I have no issues with them and they are pretty awesome. I was just wondering about this hypothetically after reading about this statute in Guy's lawsuit thread..

Let me guess you work at US STEEL

If they pay your SS, you are an "Employee"
If you get a 1099 you are not an "Employee"

I do not work at US Steel. And I pay all of my own SS and I get a 1099.

See IC 34-28-7-2 section 2 (2)

From what I get its a grey area they may be able to ask you to disclose but you are kind of protected by the above mentioned IC.
