You know, that leads me to a question: If I had had to shoot the dog, what then, assuming the neighbor attacked? His weapon, the dog, would be gone. It'd be like drawing on someone with a knife, who subsequently throws the knife away and continues to attack.

Justifiable shooting even though unarmed? That's dealing in too gray an area for me.

I agree with Caleb. You would have reason to fear for your life - or at least "great bodily harm" from a "mad" man.

If the dog is dead, he is no longer armed.

True - But! One's KILLER doesn't have to be armed. How many people have been beaten to death? Strangled? Drowned?

Being in fear of one's life doesn't HAVE to involve inanimate objects.

I'm 5'1", 58 yo, and not in good physical condition. Could I defend myself against someone - even without the attacker having a weapon? I doubt it. I would have to be awfully lucky - to the point of it being called a "miracle"

(Of course if you're a 6'4", muscle bound, athlete type and your attacker is -say- 5'9", that argument probably wouldn't hold up in court.)

I'm 6'2", 30 years old, muscular, and martial arts first instructor level.

Therein lies the disparity of force dilemma.

Not fast. I can run distance.

I'm just not sure how to handle a situation like that - I'm not going to try to H2H with a gun in my hand, but there'd be no time to holster the thing.
