At first I thought it was ridiculous that a no fly list member could buy a gun if they were a suspected terrorist. Then I believe it was Mr. Relford who pointed out that while on the very surface it sounded reasonable, but then the issue that there is no due process to get off of it really. That sounds about a good idea as the death penalty with no chance for an appeal.
Given how relatively easy it is for those who SHOULD be on the no fly list to get weapons of ALL types via the black market (Paris attackers anyone?), I dont see a good reason to even CONSIDER the thought of that.
Well there is due process to get off the list, you can go to court and petition to have it removed. There is just a couple problems with it, they don't have to tell you if you are on it and they don't have to tell you why. So that makes it just a bit difficult.
But as others have mentioned there is no due process to being added, no convictions required, etc. banning people on the list would seem to be an affront to the Constitution. Specifically the 2nd and 5th Amendments.
ETA iirc there was legislation proposed to ban people on the no fly and watch lists from owning firearms, but it was shot down quickly.
