Would you really want anyone you can think of in congress making decisions within this window. Picture John McCain or Chuck Schumer

I understand why they want a civilian order of succession but it could be a recipe for disaster. I would hope that the soviets understood sub commanders were not totally constrained by PALs and could launch on their own authority
